1. Who you are contracting with
CutterLog ("CutterLog", "we", "us") is operated by Brehau Softwares.
These terms form a binding agreement between us and the organisation that signs up ("you", "your organisation"). If you are accepting these terms on behalf of a company, you confirm you are authorised to do so.
2. The service
CutterLog is a web application for managing cutting tool inventory, tool consumption and breakage records, tool assemblies, material damage records and related reporting, for machine shops.
We may add, change or remove features over time. If we remove or materially reduce a feature you are actively relying on, we will give you at least 30 days' notice by email to your account's registered address.
3. Accounts, roles and your team
Your organisation has two kinds of account: supervisors, who have full access, and operators, who can record consumption and material entries and view inventory but cannot amend history or change settings.
Supervisors create accounts for their team and set their initial passwords directly. That design exists because operators typically work from a shared terminal and often have no work email address. It has a consequence you are responsible for:
- You are responsible for who you give accounts to, for the passwords you set, and for everything done under those accounts.
- You must remove access promptly when someone leaves. Archiving a member in Settings revokes their access immediately.
- You must tell your team that their name is recorded against every entry they make. See section 9 of our Privacy Policy — in most jurisdictions this is your legal obligation as their employer, not ours.
Do not share supervisor credentials. A supervisor account can read and change everything in your organisation.
4. Your data belongs to you
Everything you put into CutterLog — your tool list, your logs, your photos, your settings — remains yours. We claim no ownership of it and we do not sell it, rent it, or use it to train machine learning models.
We use your data only to provide the service to you, to keep it secure and backed up, to diagnose faults, and to send the alerts you have configured. Aggregate, fully anonymised statistics that cannot identify you or your organisation (for example "the median shop tracks 300 tools") may be used to improve and describe the product.
You can export your inventory and logs to Excel and PDF from within the application at any time, on any plan, including during a trial and after cancellation while your account remains accessible.
5. Acceptable use
You agree not to:
- attempt to access another organisation's data, or probe, scan or test the security of the service other than against your own organisation's data;
- resell, sublicense or provide the service to third parties as a service of your own, without our written agreement;
- upload malware, or content that is unlawful or infringes someone else's rights;
- use the service to store special category personal data (health, biometric, racial or ethnic origin, and similar) — it is not designed or secured for that purpose;
- place automated load on the service that materially degrades it for other customers.
Reporting a security flaw you discover in good faith is welcome and will never be treated as a breach of these terms. Email support@cutter-log.com.
6. Plans, trials and billing
Plans differ by the number of supervisor accounts and machines included. Operator accounts are unlimited on every plan. Current plans and prices are on the pricing section of our site.
Trials
New organisations start with a 30-day free trial on the Starter plan. No payment details are required to begin, and the trial gives you Starter's limits — one supervisor, four machines, and unlimited operators.
We will tell you before the trial ends. If you do not subscribe, your account moves to a read-only state rather than being deleted — see section 7. You can move to a paid plan at any point during the trial, and doing so raises your limits immediately.
Payment
Subscriptions are billed monthly in advance in US dollars, unless agreed otherwise in writing. Prices exclude any VAT or sales tax, which will be added where applicable.
Price changes
We may change prices. For existing customers, any increase takes effect no sooner than 30 days after we email you, and never mid-billing-period. If you do not accept an increase, you may cancel before it takes effect.
Failed payments
If a payment fails, we will retry and contact you. If it remains unpaid, your account becomes read-only — you keep access to your inventory and history, you simply cannot add new entries until payment succeeds. We do not lock you out of your own records over a failed card.
Refunds
Monthly fees already paid are non-refundable, except where required by law or where we have failed to provide the service materially and have not fixed it after you told us. We do not charge a cancellation fee and there is no minimum term.
7. Cancellation and what happens to your data
You may cancel at any time. Cancellation takes effect at the end of the current billing period; you keep full access until then.
After that:
- Your account becomes read-only for 60 days. You can sign in, view everything and export it.
- After 60 days we may permanently delete your organisation and all its data.
- You can ask us to delete everything sooner. We will do so within 30 days of your request.
Export before you need to. We are not liable for data you lose by leaving it past the retention window after we have told you it is ending.
8. Availability and support
We aim to keep CutterLog available at all times, but we do not offer a guaranteed uptime commitment (an "SLA") on our standard plans. The service depends on third-party infrastructure — see the sub-processor table in our Privacy Policy — and an outage there can become an outage here.
Support is by email at support@cutter-log.com. We aim to respond within one business day. For sales, billing and general enquiries, use contact@cutter-log.com.
9. Accuracy — please read this one
CutterLog records what your people tell it. It shows a stock count based on the entries that have been made. It cannot know about a tool taken from the crib and never logged.
That means the numbers in CutterLog are a record, not a physical count, and you should not treat them as one. Purchasing decisions, production planning and stock valuation remain your responsibility, and periodic physical stock checks remain necessary. We are not liable for losses arising from acting on figures that were inaccurate because of missing, late or incorrect entries.
10. Warranties and limitation of liability
The service is provided "as is". To the fullest extent permitted by law we exclude all implied warranties, including fitness for a particular purpose.
We are not liable for: lost profits, lost production, machine downtime, scrapped parts, delayed jobs, lost or corrupted data beyond our backup obligations, or any indirect or consequential loss.
Our total liability to you for all claims in any 12-month period is capped at the total amount you paid us in the 12 months before the claim arose.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
11. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, if your account is used unlawfully, or if non-payment continues beyond a reasonable period after notice. Except where the breach is serious enough to require immediate action, we will give you notice and a reasonable chance to put it right first.
If we terminate for any reason other than your breach, we will refund any prepaid fees for the unused part of your billing period.
12. Changes to these terms
We may update these terms. For material changes we will email your registered address at least 30 days before they take effect. Continuing to use the service after that date means you accept the updated terms. If you do not, you may cancel.
13. Governing law
These terms are governed by the laws of the Federative Republic of Brazil, without regard to its conflict of law rules. The courts of the comarca in which Brehau Softwares has its registered office have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court.
If you contract with us as a consumer rather than on behalf of a business, nothing above removes any protection you have under the mandatory law of the country you live in, or your right to bring proceedings there.
If any provision is found unenforceable, the rest remains in force.
